Acceptance and authority

By accessing or using this site, you agree to these Terms of Use and the Privacy Policy. If you submit information for a business, you represent that you are at least 18 years old and authorized to act for that business. If you do not agree, do not use the site.

Site purpose; no processing approval

The site provides general information and a preliminary processing-fit workflow. A submitted Fit Check is a request for review, not an application approval, rate quote, credit decision, offer, or promise that processing will remain available. Approval, pricing, reserves, limits, funding, equipment credits, term, and termination rights are determined through underwriting and the final agreements.

FPS is not providing legal, tax, medical, regulatory, investment, or accounting advice through this site. Merchants remain responsible for their products, claims, licenses, website content, customer transactions, and compliance obligations.

Accurate submissions and document authority

• Provide complete, current, and accurate information and promptly correct material changes.
• Upload only documents you own or are authorized to provide for underwriting and processing review.
• Do not disguise the business category, transaction type, product, fulfillment method, descriptor, processing history, termination, reserve, chargeback, or MATCH/TMF information.
• Do not upload cardholder data, bank credentials, Social Security numbers, tax identification numbers, dates of birth, passwords, medical records, or authentication codes.

Acceptable use

You may not misuse the site; bypass access or rate controls; introduce malicious code; scrape or probe the service without authorization; impersonate another person; submit unlawful or infringing material; interfere with other users; or use the site to facilitate fraud, transaction laundering, prohibited products, misleading descriptors, or evasion of underwriting or card-network requirements.

Electronic communications

You consent to receive records related to your request electronically at the email address supplied. Optional call or text consent is governed by the separate Communication Terms and is not required to receive a processing review. Carrier and internet charges may apply.

Site content and feedback

The site design, copy, graphics, software, and FPS branding are owned by FPS or its licensors and are protected by applicable law. You may use them only to evaluate or request FPS services. If you voluntarily provide product feedback, FPS may use it without restriction or compensation, but this does not transfer ownership of your confidential business records or uploaded statements.

Third-party services

The site may depend on or link to third-party services. FPS does not control their separate terms, availability, security, or content. Any acquiring institution, processor, gateway, sponsor bank, or equipment provider is governed by its own approved agreement and disclosures.

Disclaimers

To the maximum extent permitted by law, the site is provided on an "as available" basis without warranties of uninterrupted availability, error-free operation, merchant approval, processing continuity, savings, rates, funding timing, or business outcome. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, FPS will not be liable under these website terms for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from use of or inability to use the site. Contract-specific liability terms in a signed merchant or services agreement govern claims under that agreement. Some jurisdictions do not permit certain limitations, so they apply only to the extent lawful.

Changes; suspension; general terms

FPS may update these terms and may suspend or end access to protect the site, users, partners, or legal compliance. Continued use after an update means acceptance of the revised terms. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. Any signed agreement with FPS or a processing partner controls over these website terms for the services covered by that agreement.
